Terms and Conditions

  1. COURSE REGISTRATION

The provision of courses is guaranteed on the date indicated at the time of booking. Reservations are personal and non-transferable.

Level assignment is based on the child’s age, abilities, and the teachers’ recommendations.

Courses are bilingual (French-English). It is possible to register for any session, and the teacher will adapt the lesson to the preferred language of the parent.

Any reservation made through any means (online, by phone, or by email) does not constitute an enrollment; payment is the determining factor.

Subscriptions operate on sessions of 6, 12, or 24 consecutive lessons (excluding school holidays). Refer to the calendar for exact dates. You may start mid-term as the lessons are personalized.

By enrolling, parents confirm that their child(ren) is/are in good physical condition and do not suffer from any medical (or other) condition that would prevent them from safely participating in swimming lessons. Additionally, parents acknowledge that the health and safety of their child(ren) remain their responsibility.

In case of doubt, a medical certificate certifying the ability to participate in physical activities may be requested.

2. PAYMENT

Full payment must be made before the first lesson. Partial payments are not accepted. The applicable price is the one in effect at the time of booking. All prices are in Swiss Francs.

By paying, you accept the terms and conditions, as well as the schedule and duration of the lessons.

SWIMI reserves the right to modify its prices, regulations, general conditions, and other contractual documents at any time. Changes will be communicated via email or on the website.

SWIMI is not bound by any erroneous data or typographical errors on its website.


 

3. TRIAL CLASS

Trial lessons are not offered. You must purchase a subscription, and if unsatisfied after the first lesson, we will refund the remaining lessons.

4. ABSENCE FROM LESSONS​

Absences will not be refunded or compensated, even in exceptional cases.

5.1 CANCELLATION INSURANCE

You can take out cancellation insurance with our partner Allianz Assurance, which will reimburse canceled lessons due to illness or accident (upon presentation of a medical certificate).

5.2 REFUND FOR CANCELED LESSONS

If you have cancellation insurance, follow these steps in case of illness or accident:

  1. Email us before the lesson at info@swimi.ch, indicating your illness or accident, your possession of cancellation insurance, and your request for an absence certificate.

  2. Send the absence certificate and medical certificate to the following address:
    https://www.allianz-travel.ch/fr_CH/sinistre.html.

  3. You will receive a refund for your canceled lessons.

6. LATE ARRIVAL TO CLASS

Late arrivals will not be compensated in any form.

7. COURSE SCHEDULE MODIFICATIONS

SWIMI reserves the right to modify course schedules. However, changes are rare during a term. A credit may be granted if the schedule change alters the start time by more than an hour. If the change exceeds this timeframe, a refund for undelivered lessons may be requested.

8. EXCEPTIONAL COURSE CANCELLATIONS

If the pool is closed due to technical issues or public health reasons, a course credit will be issued. However, no refunds will be provided.

 

9. PARENTAL PRESENCE AND RESPONSIBILITY

A parent must be present in the water with the child during lessons. The child remains under their responsibility. The lesson begins at the scheduled time, meaning the parent and child should be ready to enter the pool at that moment.

Children are under their parents' responsibility both in and out of the water. Parents must ensure their child is not left alone near the pool and must always hold their hand to prevent slipping. Parents and children must wear non-slip sandals.

Participants must have individual insurance (accident and liability) to attend lessons. Parents affirm having such coverage for both the child and the parent accompanying them in the water.

SWIMI is not responsible for incidents before or after lessons or for theft in locker rooms or near the pool.

10. SECOND ADULT PRESENCE

A second adult may attend lessons but only outside the water. Alternating between parents in the water is allowed. If neither parent can attend, another family member (e.g., uncle, aunt) may accompany the child.

11. MEDIATION CLAUSE

In case of dispute, the parties agree that, before initiating legal proceedings, they will attempt to resolve it through mediation, with the help of a mediator.

12. LEGAL JURISDICTION

Only Swiss law is applicable to this contract. Any dispute regarding this contract is subject to the jurisdiction of Lausanne.

13. PERSONAL DATA PROTECTION

Unless legally required, user's personal data is treated confidentially. SWIMI reserves the right to use data for statistical and marketing purposes. However, no user's photograph will be published without their express prior consent. Parents are not allowed to film or photograph classes without prior written consent.

 

The use of surveillance camera images is reserved for security purposes and in case of disputes.

14. USAGE CONDITIONS

By accepting the general conditions, you also accept the terms of use. These are attached in the annex. SWIMI offers products sold online on the website www.swimi.ch. By placing an online order, the buyer accepts the general sales conditions as well as these general conditions.

15. EXCLUSION

Anyone not adhering to these General Conditions and Terms of Use may be excluded from classes without refund or compensation.

Annex: Terms of Use

 

Facilities:

  • Any damage will be charged to the perpetrator.

  • Please use the provided items normally.

  • No parking space is included in the fee unless specifically indicated on the website www.swimi.ch.

  • Wearing sandals or appropriate shoes is mandatory inside the premises. If parents do not wish to wear sandals themselves or have their children wear them, they take full responsibility.

  • Running inside the pool area is prohibited. Parents ensure the good general behavior of their child(ren).

 

Parents:

  • Must set an example for younger ones, showing courtesy, exemplary behavior, politeness, and calmness towards other children, teachers, and parents at all times.

  • Must prevent their child from any use of violence, foul or offensive language, inappropriate conduct, etc.

  • Are required to adopt a decent and appropriate attire to access the pool edges.

 

Children:

  • Must have their own swimwear; a swimsuit is mandatory. For children under 3 and those not potty-trained, they must wear two layers: a disposable one and a non-disposable neoprene one (swimsuit).

  • Must arrive on time.

  • Children must exhibit appropriate behavior and language.
